If you make a reservation or utilize our services, you consent to these Terms. Should you not agree with any portion of these terms, you are not permitted to access the Service.
2. Service Overview
Ocean's Elegance Marina Club offers luxury yacht chartering services, which include but are not limited to:
- Rental yachts for daily use
- Evening boat tours
- Company retreats
- Exclusive gatherings
- Extended yacht charters
Our services are contingent on availability and the conditions of the sea. We retain the authority to adjust or terminate our services at any time without notice.
3. Booking and Reservations
3.1 Booking Process
Requirements for booking a yacht include:
- Minimum age of 18 years
- Submission of precise and full information
- Advance deposit payment as indicated in the booking confirmation
- Acceptance of these Terms & Conditions
3.2 Confirmation
A booking is regarded as confirmed only after we have received the payment and issued written confirmation. We reserve the right to deny service at our discretion.
3.3 Availability
Charter scheduling is based on the availability of the vessel and favorable weather conditions. We will endeavor to meet your requested dates and times within reasonable limits.
4. Payment Terms
4.1 Pricing
All charges are quoted in £ and are inclusive of all relevant taxes unless stated otherwise. Our prices may change without prior notice.
4.2 Payment Schedule
- Deposit: Half of the charter cost due at the time of reservation
- Final payment: Due two days before the charter's scheduled departure
- Supplementary fees (if applicable): Payable at the end of the charter
4.3 Payment Methods
We accept various forms of payment, including major credit cards, wire transfers, and certified cheques. Payments are processed using secure encryption technology.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- With over 72 hours' notice before departure: Refund in full minus transaction fees
- Between 24 and 72 hours' notice before departure: Half of the amount will be refunded
- With less than 24 hours' notice before departure: Non-refundable
5.2 Weather Cancellations
In the case that our captain deems weather conditions to be unsafe, we shall propose to:
- Reschedule the charter for another available date at no extra charge
- Issue a complete refund if a new schedule cannot be arranged
5.3 Mechanical Issues
If your assigned yacht encounters mechanical issues, we will make an effort to supply an adequate alternative. If this is not feasible, you will be fully reimbursed.
6. Safety and Conduct
6.1 Safety Requirements
All passengers must:
- Obey all instructions provided by the crew
- Use the safety equipment when instructed
- Inform us of any medical conditions that could impact their safety during the charter
- Stay within specified sections of the yacht
6.2 Prohibited Items
There is a prohibition on the following items on board:
- Glass containers
- Illegal contraband
- Firearms or other weapons
- Items beyond reasonable quantities for personal consumption
- Pets (save for those that have been approved before the trip)
6.3 Conduct
Passengers are expected to act respectfully at all times. We hold the right to end a charter prematurely and without any refund if the conduct of any passenger endangers safety or detracts from the enjoyment of other people on board.
7. Liability and Insurance
7.1 Our Liability
We are only liable up to the cost paid for your charter. We are not responsible for:
- Personal injuries that are a result of passenger misconduct
- The loss or damage of personal belongings
- Indirect, incidental, or punitive damages
- Delays arising from unfavorable weather or situations outside our control
7.2 Insurance Coverage
We carry full marine insurance to cover our vessels and operations. Passengers are encouraged to ensure their own travel and personal insurance.
7.3 Assumption of Risk
By deciding to partake in our charter services, you recognize the innate hazards associated with marine activities and accept responsibility for your personal safety and care.
8. Modifications and Itinerary Changes
We hold the right to alter itineraries, paths, or schedules due to considerations of weather, safety, or operational necessities. We aim to provide alternatives that are as similar as possible to the original experiences.
9. Force Majeure
We shall not be held responsible for any hold-ups, terminations, or alterations that result from events outside our reasonable control, such as:
- Extreme weather conditions
- Natural catastrophes
- Governmental orders
- Shutdowns of ports
- Mechanical breakdowns
